Complaints Against Members or Academic Institutions
The NCMA will review all complaints or concerns brought to our attention regarding members or academic institutions. If a situation arises in which a possible violation has occurred, the NCMA will allow for the accused party to provide a response, which will be evaluated by the NCMA Administration, and Advisory Board. If a violation is determined, NCMA will keep record, and take the appropriate action(s) in relation to the complaint.
There will be no acceptance of anonymous complaints, however, the NCMA will keep confidential the complainant(s) during the complaint investigation. Should a violation be determined, the NCMA cannot guarantee the confidentiality of the complainant upon issuing notification of the finding.
All complaints must be submitted in detail via the NCMA website within 180 days from the event occurrence. Within 30 days of the complaints receipt, NCMA notify the submitter that it will commence an evaluation to determine the validity and applicability of the complaint and provide notification as to whether the complaint will be pursued or request additional information from the complainant.
If the complaint is determined to be not applicable, or unfounded, notification will be sent to the complainant to state such. The complaint will then be formally closed.
If the complaint is determined to be valid, all evidentiary pathways will be pursued to ascertain a final decision as to whether a violation has occurred. Notice of the violation will be sent to the member or academic institution to notify them of such. The member or academic institution will have up to 45 days to respond to the notice detailing the findings, which includes the submission of rebuttal information or contrary documentation.
If the member or academic institution fails to reply in the 45 day response window, the complaint and findings will be issued a reprimand, which may include suspension or revocation of certification(s).
If the member or academic institution provides a response, rebuttal inform or contrary documentation in the 45 day response window, the submission will be reviewed, and a redetermination of violation will be made. If it is determined that no violation occurred, the complaint will then be closed. If it is determined there is a violation finding(s), the member or academic institution will be issued a reprimand, which may include suspension or revocation of certification(s). Should a certification become suspended or revoked, that annotation will also be included with the current standing public online verification database.
